    Legally Permissible

    The first test in highest and best use analysis: a use must be allowed under current zoning, building codes, environmental regulations, deed restrictions, and other legal constraints to be considered.

    The legal analysis considers zoning classification (permitted uses, conditional uses, variances), private deed restrictions and covenants, historic preservation requirements, environmental regulations (wetlands, flood zones, contamination), and building codes. A use that requires a zoning change is generally not considered legally permissible unless there is a reasonable probability of obtaining the change. The appraiser should research the specific zoning ordinance, check for deed restrictions, and consider any pending regulatory changes that might affect permissible uses.
